On the question of tips, under the Regulations 2022, Part 2.2 an ‘allowance’ means any sum of money payable to a relevant employee in relation to (a) an ancillary duty of the employee.

Deloitte’s position would be that the inclusion of tips would not be in the spirit of the legislation and would not be considered remuneration, as they are not a payment by the employer to the employee. Therefore, you would not include tips as part of any gender pay gap calculations. It is also important to note, in practise, it would be very difficult for employers to manage the value of tips to each employee as most companies allow employees to split any tips between the rostered staff at the end of the shift.
